Our procedures for reporting copyright infringement and requesting removal of allegedly infringing material.

DMCA Policy Overview

FilterTested respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines the procedures for reporting copyright infringement and for submitting counter-notifications.

We will respond to valid DMCA takedown notices by removing or disabling access to the allegedly infringing material. We will also terminate the accounts of repeat infringers where appropriate.

How to Submit a DMCA Notice

To file a valid DMCA takedown notice, your written communication must include the following elements as required by 17 U.S.C. § 512(c)(3):

  1. Physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (such as the specific URL).
  4. Contact information for the notifying party, including an address, telephone number, and email address.
  5. A statement that the notifying party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the notifying party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important: Misrepresentations made in your DMCA notice regarding whether material or activity is infringing may expose you to liability for damages (including costs and attorneys' fees) under 17 U.S.C. § 512(f). If you are unsure whether the material you are reporting is actually infringing, you may wish to contact an attorney before filing a notice.

Counter-Notification Procedure

If you believe that material you posted on FilterTested was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To be valid, your counter-notification must include the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the United States District Court for any district in which FilterTested may be found if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If the original complainant does not file a court action seeking an injunction against the infringing activity within 10 business days, we may restore the removed material at our discretion.

Repeat Infringer Policy

FilterTested maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We reserve the right to terminate access to the website for any user who repeatedly infringes the copyrights of others, as determined in our sole discretion.
